TERMS AND CONDITIONS
Delay
Unless the parties agree otherwise in writing, the carrier shall not be liable for any special, consequential or other damages caused by delay in the delivery of a shipment, regardless of the cause of such delay.
Limits Of Liability
Carrier shall not be liable for any loss, destruction or unreasonable delays arising from the following causes:
- Acts of God, Queens, or public enemies;
- Riots;
- Strikes;
- Authority of Law;
- Defect or inherent vice in the goods;
- Act of default of the shipped or owner of the goods;
- Nuclear reaction, radiation or radioactive contamination;
- Disruption of normal interconnecting transportation facilities;
- Carrier’s liability for any loss, damage, or injury to a shipment shall not exceed the less of $1.50 per pound or $50.00.
The carrier shall not be required to accept any shipment with a declared value in excess of $200 unless agreed to prior in writing by the carrier.
Articles Of Extraordinary Value
The carrier shall not be bound to carry any documents, collections, species, gold, silver, precious stones, or articles of extraordinary value unless a special agreement to do so has been made (the duty of obtaining such special agreement to be on the consignor) and the stipulated value of the articles is endorsed thereon and supported by independent appraisal and if such goods are carried without a special agreement the carrier shall not be liable for any loss or damage thereto.
Damage
Any damage must be noted on Pro Bill at the time of delivery, otherwise consignee’s signature will constitute a clear receipt. Any notice of concealed damage must be given to the carrier within 24 hours after delivery. The carrier will not be liable for such damage or any loss unless written notice thereof is given to it within 10 days after the shipment was received by it for carriage. Additional pieces to same consignee are charged at 50¢ each, 5¢ per pound over 50 pounds.
